1. Ownership
All skip bins remain the exclusive property of Dynamite Bin Hire at all times. The hirer acquires no ownership rights or interest in the skip bin, whether during the hire period or otherwise.
2. Hire Period
- Hire commences upon delivery of the skip bin.
- The standard hire period is seven (7) days from the date of delivery, unless otherwise agreed in writing at the time of booking.
- If the skip bin is not collected within the standard hire period and the delay is not caused by Dynamite Bin Hire, an additional hire fee may be charged for each additional day until collection occurs.
- The hirer must ensure that the skip bin is accessible on the agreed date of collection.
- If the skip bin is not accessible on the agreed date of collection, a call-out fee of $110 plus GST may be charged.
3. Placement, Access, and Site Conditions
- The hirer warrants that access to the site is safe, clear, and unrestricted, including a minimum driveway width of 3 metres and sufficient overhead clearance.
- The hirer warrants that the ground surface is firm, level, and capable of supporting the combined weight of the delivery truck, the skip bin, and the contents.
- The skip bin must not be moved, relocated, or interfered with once placed.
- Dynamite Bin Hire accepts no liability for damage to lawns, driveways, concrete, paving, asphalt, kerbs, underground services, sprinklers, septic systems, or landscaping.
4. Concrete and Surface Damage
- The hirer acknowledges and accepts that delivery, placement, loading, and removal of skip bins may cause damage to concrete, paving, driveways, or other surfaces, including cracking, chipping, scuffing, or subsidence.
- To the maximum extent permitted by law, Dynamite Bin Hire is released from all liability for such damage.
- It is the hirer’s responsibility to protect surfaces if required.
5. Council Permits and Public Land Placement
- Where placement of a skip bin on public property, including roads, footpaths, or nature strips, is required, the hirer must obtain the required council permit through Dynamite Bin Hire.
- The cost of the permit and a small administration fee will be charged to the hirer in addition to bin hire fees.
- Dynamite Bin Hire will arrange the permit application on behalf of the hirer.
- Delivery is conditional upon Council approval of the relevant permit.
- The hirer acknowledges that timing and conditions of permit approval are outside the control of Dynamite Bin Hire.
6. Loading and Overfilling
- Skip bins must not be loaded above the top rim or in a manner that renders them unsafe for transport.
- Loads must be evenly distributed.
- Dynamite Bin Hire reserves the right to refuse collection or impose additional fees for overfilled, overweight, or unsafe bins.
7. Prohibited and Restricted Materials
The following materials must not be placed in the skip bin under any circumstances:
- Asbestos or asbestos-containing materials
- Paint, solvents, oils, fuels, or liquids of any kind
- Chemicals, pesticides, or hazardous waste
- Gas bottles, batteries, or pressurised containers
- Medical or biological waste
- Explosives or flammable materials
The hirer is liable for all costs and expenses incurred due to prohibited materials, including removal, disposal, decontamination, fines, and penalties.
8. Special Items and Additional Fees
- Mattresses, car tyres, and car batteries are not permitted unless declared prior to hire and approved, and are subject to additional fees.
- Failure to declare these items may result in extra charges or refusal of collection.
9. Waste Type and Contamination
- The hirer must only place approved waste types in the skip bin.
- Contamination of a bin or placement of incorrect waste may result in reclassification and additional disposal charges.
10. Damage, Loss, and Theft
- The hirer is responsible for all damage, loss, or theft of the skip bin or its components while on site.
- Charges for repair, replacement, or recovery will be invoiced to the hirer.
11. Refusal of Service
Dynamite Bin Hire reserves the right to refuse delivery or collection if the skip bin or site does not meet these Terms, if prohibited materials are present, if the bin is unsafe, or if permit conditions are not satisfied. Additional fees may apply.
12. Indemnity
The hirer indemnifies and holds harmless Dynamite Bin Hire against all claims, losses, damages, fines, costs, and expenses arising from misuse of the skip bin, prohibited materials, overfilling, unsafe placement, or any breach of these Terms.
13. Undeclared Items and Administration Fees
Where undeclared restricted, special, or prohibited items are found in a skip bin, Dynamite Bin Hire may charge all reasonable disposal costs, handling fees, and a reasonable administration fee to cover sorting, compliance, and processing.
14. Payment and Cancellation
- Payment is due prior to or at delivery, unless otherwise agreed in writing.
- Cancellations after booking confirmation may incur a cancellation fee.
- No refunds will be issued once the skip bin has been delivered.
15. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia.
16. Acceptance of Terms
By booking or using a skip bin from Dynamite Bin Hire, the hirer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
